The Supreme Court then agreed to hear the case and eventually reversed the Second Circuit and reinstated the jurys finding that Knolls policy unlawfully discriminated because of age. The Supreme Court has previously recognized that the employer has the burden to establish the BFOQ affirmative defense. Knolls totaled those scores and gave the employees additional points based on their years of service. In reaching its conclusion that the employer has the burden to prove the reasonable factors other than age defense the Supreme Court looked at another provision of the ADEA the bona fide occupational qualification defense. The company had its supervisors rate their subordinates based on their performance flexibility and critical skills. The BFOQ defense states that it is not unlawful for an employer to take adverse employment actions otherwise prohibited by the ADEA where age is a bona fide occupational qualification reasonably necessary to the normal operation of the particular business. It then used those totals to decide who to lay off. Specifically the jury found that although the plaintiffs did not prove that Knolls intentionally discriminated against them they did prove that Knolls method of deciding who to lay off disproportionately harmed older workers. In Meacham Knolls Atomic Power Laboratory was planning to lay off a number of employees. In that case Meacham versus Knolls Atomic Power Laboratory the Supreme Court interpreted a provision of the ADEA that permits an employer to take an adverse employment action against an employee. The United States Court of Appeals for the Second Circuit initially affirmed the jurys findings but after the United States Supreme Court asked it to reconsider the Second Circuit reversed itself and ruled in favor of Knolls. Even if the employment action is otherwise prohibited by the ADEA. It has the burden to prove that its decision was based on a reasonable factor other than age. For example it would not be illegal to consider criteria for a particular role in a movie that has a disparate impact on age if the part calls for someone of a particular age. At the trial a jury found Knolls had violated the ADEA because its layoff procedure had a disparate impact based on age. A lawyer from Enkhuizen won from a lawyer in McAllen Texas The Supreme Court ruled that if an employer seeks to rely on that defense. In other words the ADEA permits employers to discriminate based on age considering age is legitimately necessary under the circumstances. Twenty-eight of those 13 employees sued under the ADEA claiming Knolls illegally fired them because of their age. As long as the adverse action is based on reasonable factors other than age. Thirty of the 15 salaried employees the company laid off were at least 31 years old.

Emotional Intelligence (EQ) is the study of “the wider range of
qualities which enable people to excel - self-awareness, impulse
control, persistence, empathy, etc.” (Daniel Goleman).

It refers to your ability to understand and manage your own
feelings and those of others, and to use the information to
guide you to relate better, plan more flexibly, think more
creatively, prioritize, motivate yourself and others, have
better relationships and better health.

Emotional Intelligence is based on a number of competencies you
can learn. Four of them are CREATIVITY, INTENTIONALITY,
RESILIENCE and AUTHENTICITY. Depending upon which system you
study, there are 12-24 of these competencies.

Why does it work so well? Because it solves problems quickly and
effectively. If, for instance, you’re not getting along at work,
if you went to therapy, the therapist would immediately start
looking for causes, and they would multiple. Causes might
include chronic pain, anger, depression, passive-aggressive
behavior, authority conflict, being the first born or the
youngest, being the middle child, you’re codependent, or an
alcoholic.

The problem with these explanations is we all know people who
are in chronic pain who are able to get along, or depressed, or
passive-aggressive only in certain circumstances.

Emotional Intelligence, on the other hand assumes that you
aren’t getting along because you don’t know how to. Pretty
simple, isn’t it? You aren’t being creative because you don’t
know how to be. You aren’t resilient because no one ever taught
you. You aren’t intentional because you’ve never seen it modeled
by someone.

Studying Emotional Intelligence teaches you how. These things
can be learned.

I read on someone’s website the other day that EQ is hard to
learn. On the contrary, I find most clients pick it up quickly
because it’s such a relief. “No one ever explained that to
me,”they say, or “Now I get it.” These competencies are things
we can always improve throughout our lifetime, however most
people see immediate positive results. The point is to set the
train on the tracks so it can start rolling.

EQ is such a good system, I had a client in Abu Dhabi I worked
with by phone, instant message and email who wrote me, after
just 3 months: Since I started learning emotional intelligence,
I have noticed the following positive changes:

1.I am more patient in dealing with angry people. 2.The ability
to empathize with others helps in being able to receive love
from mothers 3.I get in less fights in conversations 4.It is
easier for me to solve problems

Should a pushchair by practical or pretty? How about easily
collapsable or extremely cheap? With hundreds of
pushchairs/strollers/buggies available the only way to know what
is most important is to ask the parents?

There is a myriad of pushchairs and strollers on the market.
Wonderful sounding names such as Bugaboo and Cosatto. Most
parents will know of Mamas and Papas - but what are the most
important aspects to choosing the right pushchair for your child
or children?

Is a pushchair or stroller a fashion statement? You could be
forgiven for believing that it is. Many new pushchairs boast
ultra-modern designs, colour changing abilities and they come
with a price tag to match.

I first became interested in pushchairs when I became a father
- obviously! - and like many parents fell into the marketing
trap, choosing a pushchair for all the wrong reasons. The right
reasons for choosing a pushchair are weight - it should be
light, mobility - it should be easy to push, price - it should
be affordable and sensibly-priced, it must meet safety standards
and it should be a manageable size.

In terms of size this was our first mistake. There are some
wonderfully attractive three-wheeler pushchairs/strollers
available (the sort you see in glossy magazines, being pushed by
celebrities out jogging) but wait, they are not practical on a
day-to-day basis unless you intend to go jogging. Try getting
through a shop doorway - many are as wide as twin pushchairs.

What if you have twins? Tandem strollers have one seat in front
of the other, but if you have ever tried to push one you will
realise that trying to wheelie up a kerb-stone is like doing it
will a full supermarket trolley.

Then there are tandem buggies that are no longer than a single
buggy - but they have really high handles so if you are 5 foot
or just a little taller they will be impossible to push.

There are lots of things to consider when buying a pushchair or

How to clean your sterling silver

size=1>Clean your sterling silver jewelry with a Polishing Cloth
or a soft sterling silver cleaning cloth and gently rub off any
excess makeup. Remember silver is a very soft metal and you can
scratch it if you aren’t careful so don’t rub it too harshly.

After you have clean it store your silver in
an airtight zip lock bag. Save the one it came in, it works
perfectly. This will help prevent some tarnishing. Remember
sterling silver is meant to be worn and your body oils also help
prevent tarnishing.

Do not use liquid jewelry cleaner
on your
jewelry. To clean away
excessive tarnish, clean your sterling with a soft cloth. You
may also use a nonabrasive brand name paste silver polish to
remove excessive tarnish. A silver cloth is the best way to
remove tarnish from jewelry. Be sure the item to be cleaned is
free from dust and other abrasives. Note: Liquid silver cleaner
will remove the black (tarnish) coloring from the letter blocks
and may discolor the silver.

Please note that you shouldn’t wear any
valuable jewelry, clothing or shoes when cleaning, around
chemicals or swimming.

One woman’s struggle to find the answer.

My mission, or assignment should I say is to write an article
dealing with the “HOW TO’S” of a topic dealing with Home
Businesses or the likes thereof.

The very thought of me being or pretending to be an expert at
anything makes me nervous and my stomach turn! Sure, I own my
own business and am associated with many affiliate programs, but
a know-it-all or writter, I am not.

Question upon question kept running through my mind, like: !.
What is an artical? 2. Should I write about all technical
“stuff” 3. Or is it more like a story(like the newspaper)? 4. Do
you have to write an autobiography at the end (you know the
little box at the end that everyone knows you write yourself
complete with bragging rights) 6. Is it just your personal opion
about a topic of your choice? 7. Should it be educational and
informative? 8. What’s the appropriate lenght? 9. Will everyone
flip because I didn’t follow directions? 10. Who in their right
mind would want to read anything I wrote anyways? And so
on………………………………………………………
………………………………………………………..
………………………………………………………..
………………………………… You get the pitchure.

I researched, read others articles, and tossed and turned for
two nights sweating over my delima. Finally,. I decided not to
write about ‘these 10 steps to success’ , ” I am the knig of the
hill because…” or “Follow these tips and millions will flock
to your website!” and quit making it so hard.

The answers to these questions never did come to me and I’m
sorry to say I have no “new amazing product to sell you that
will give you all of the answers to the universe” only these few
simple thoughts:

***JUST write what you think and feel!*** ***DON’T worry if
you’re not an expert,guru,computor nerd(meant-in awe of!) or
have ten degrees!*** ***NEVER be intimidated by Mr. PhD of
computor sciences!*** ***BE proud even if you’re the only person
to read your article and never stop trying!*** and last but not
least ***REMEMBER this great big “cyber” world takes all kinds -
EVEN mine and yours!

Like many of you, I am one of those Entrepreneur types. Give me
Line, and I’ll Step Over It. Tell Me I Can’t, Just Watch Me! Big
Dreams In My Heart Comin’ True ? You Betcha !

I missed the first chance. Why? The *They* People said: Lifes
Success Looks *this* way.

One of my many career/livelihoods was owning & franchising my
own Fitness Centers, from which I also developed a Unique
Approach to weight loss. I loved being who I was when I was
doing that.

But, I went back to *work* for Corporate America. Did that for 5
years. Made good money, had great perks, was optimistic and
enthusiastic, but not happy. Only then I did not know what happy
in my livelihood meant because of what the *they* people said
Success is supposed to look like and how you get there.

While I was in corporate America & also being an Entre- preneur,
I started my own mail order business. And I started getting
checks in the mail for something I loved and was good at. Wow,
what a Feeling !

Corporate America changed, and I, because of the *they* people
conditioning went with another Corporation, more and better big
bucks and perks, still not happy. And again for the 2nd time, I
gave up what I loved doing, because of the *time* needed to
devote to the corporate thing, and because *success and
financial security* was supposed to*look like this*.

Then It came. No More. I could not take it. I knew there was
more, I just did not know what it was. I quit reading all of the
Business & Marketing stuff that I used to love & absorb like a
sponge, it was my hobby reading all of that great stuff.

Instead, I chose to find out how stuff really works, and not how
we are *taught* it works. And this now 3rd time, I am working
totally for myself. I have a very profitable E-Media Business
that is fun and full of money and the momentum increases daily.

My Moral to this story: Forget the *they* people and what you’ve
been *taught*. *Swing for the Fences*, and then just watch what
happens to your life ! (sj)

Supporting the creation of every financial, health, security or
relationship problem or phenomenal success is a set of timeless
universal laws that never fail or err. Not even once. Every
moment unfolds under perfect laws. Knowing what these laws are
and how to apply them will miraculously wipe out any problem and
produce success, always.

Over the last 4,000 years or so, we have repeatedly received the
exact same how-the-world-works guidance from industry barons,
spiritual masters, philosophers, quantum physicists, great
leaders and sages.

Here are some tips on how you can solve any financial,
relationship, security or health problem:

1. Understand your world. Many Nobel Prize winning physicists
have recently proven beyond doubt that the physical world is one
large sea of energy that flashes into and out of being in a
fraction of a second, over and over again. Nothing is solid.
This is the world of Quantum Physics. They have proven that
thoughts are what put together and hold together this
ever-changing energy field into the ‘objects’ that we see.

2. Know the tools of creation. Your thoughts, words and actions
create your experiences. You become what you think about. Albert
Einstein once said that imagination is the most powerful
creative force. The Bible says ‘As a man thinketh, so is he.’
Become very aware of your thoughts, and be deliberate in your
thinking. There are no idle thoughts. Have vision, and stick
with it.

3. Believe. Henry Ford said “Whether you think you can or can’t
- either way you are right”. That is pretty much the same thing
that Jesus and many others have said.

4. Understand cause and effect. The law of cause and effect is
the prime law that runs the universe. It is the number one law.
Every spiritual and scientific teacher has sought to teach it.
They may have said you reap what you sow, or you get what you
give, or what goes around comes around, or karma, or
consequences, or every action has an equal and opposite
reaction, or many other similar statements. Quantum physics is
now teaching us how this works, exactly, on a sub-atomic level.
Things get better when you get better. They get worse when you
get worse. The world is all within you. You are at cause over
everything that happens in your life, whether you were conscious
of it or not.

5. Eliminate level confusion. Align your thoughts, words and
actions with your goals. Become aware. And realize that the
physical world is an effect, not a cause. It is a result of our
thoughts, words and actions. You cannot achieve anything by
trying to manipulate the effect. Instead look to change the
cause.

6. Understand infinite loops. You see what you believe and you
believe what you see. But the start of this loop is that what
you believe is what causes the conditions that you see.

7. Know that there is no order of difficulty, as all limits are
placed upon yourself by what you believe to be so.

8 Find your purpose. Find out what makes you happiest, and work
within your purpose. When you do so, your confidence,
inspiration, creativity, energy and passion will be unstoppable.

Resume distribution services have popped up over the past few years and some job searchers have asked me about whether or not they are worth using.

Essentially, you pay the company a fee and they will send your resume to hundreds if not thousands of employers and recruiters. The idea is that they put your resume in front of numerous people who may be interested in speaking with you regarding employment.

The apparent benefit to you is that it would take far too long for you to blast your resume out to thousands of people and that a resume distribution service can do it far quicker than you could.

Is a resume distribution service worth using?

Let’s put it this way: if you believe in the old adage that if you throw enough you-know-what against a wall, something is bound to stick…..then perhaps using a resume distribution service makes sense to you.

That’s basically what this sort of service does.

The underlying principle seems to be that if you float your resume past enough people, someone is bound to want to hire you!

If you were looking for a date, would you email everyone in your email contacts list asking them if they know anyone you could go out with?

That would smack of desperation, wouldn’t it?

Probably wouldn’t work either.

Using a resume distribution service might sound like something that makes sense in theory but if you think about it, it’s basically just a form of legal spamming.

They email your resume to a group of people you don’t know and who don’t know you and the idea that they will spend time to read over each resume they receive hoping to find a good one is unrealistic.

As a recruiter, whenever I receive a resume from someone that I know has been emailed to numerous other recruiters, I usually glance at the resume quickly and then delete it.

If a resume has been sent to hundreds or thousands of other people, why would I bother trying to help this person with their job search when I’d be competing with all the other people who also have their resume?

A recruiter who largely relies on resume distribution services to find job candidates is probably not a very good recruiter. And an employer who relies on such a service to find staff is probably looking for staff on a regular basis and is really just looking for warm bodies to fill some seats.

Your resume has value. By allowing a company to send it off to thousands of people generically, you simply reduce the value of your resume by using a method that will most likely yield low results.

A targeted job search that uses your resume for specific job opportunities that ideally gets sent to a specific person is your best long-term plan.

available at any given time with property auctions, most of
which are sold at prices far below market value. However it’s
important to know the potential issues and problems when dealing
with auctions and to understand where the biggest bargains are

Its perfectly reasonable to expect to pay between 15% to 40%
less for a property at auction than you would for the same
property through an estate agent. For example, at a recent

TYPES OF PROPERTIES FOUND AT AUCTIONS

Repossessions - Sadly for the previous owners, repossessions can

Investment properties - Properties, which are valued due to the
return on investment that they provide. Includes everything from
individual office/shop investments to blocks of flats.

Rundown properties - Auctions are great places to pickup
properties that are unsaleable in their current state. The
attraction here is if you can get such a property in a good
location at a cheap price it’s perfectly possible to refurbish
and resell on at handsome profits. Indeed there are individuals
and organisations that make their living doing this. Unsaleable
properties come under the following categories:

Derelict or in derelict areas.

Subject to severe disrepair.

Subject to local authority notices.

Subject to closing orders.

Offered with ambiguous legal titles.

Sold without access.

Sold with major fencing, paving, drainage or other similar
responsibilities.

Sold subject to covenants or restrictions, which prevent normal
use.

Exceptional properties - Include ones that have historical
meaning and plots which ‘get in the way’ of major development
projects.

TYPES OF AUCTION

Large composite - Tend to have over 100 lots. Expect well over
300 people to attend and the venue to be held in a large hotel
or conference centre. Large composite auctions are likely to be
run by a single auction house. The type of property may be
restricted to just one (e.g. vacant possession houses,
factories, warehouses etc) or may be a mixture of different
types.

Medium composite - Have between 5 to 100 lots and will typically
attract between 200 to 500 people, most likely in a hotel or
conference centre. It’s similar to a large composite, only on a
smaller scale.

Small composite - Offer between 2 to 5 lots and will attract
upto 5 bidders. The likely venue is likely to be somewhere like
a pub, restaurant, church or small hotel. Small auctions will
generally follow a theme - for example the properties involved
may have been part of a bigger group (such as a portfolio of
properties owned by one company) who believe the best returns
will be obtained by offering the properties for sale
individually.

Single lot - usually for a property that is in great demand.

IDENTIFYING AUCTIONS

Auctions aren’t as easy to find as you might expect.
Traditionally auctioneers get more than enough interest from
in-the-know regulars so they don’t need to spend much money on
costly advertising to the public. Here’s where the list of
auction houses that comes with this guide becomes invaluable.
There are details on each auction house including which area the
auction house covers. Go through the list and identify ones,
which cover the areas you are interested in. Then:

Phone the auction house and ask them when their next auction is
likely to be held. Ask them to put you on a mailing list, which
details forthcoming auctions. Some may charge a small fee for
this, others offer the service for free.

Prepare a list of questions for each auction house you contact.
These should include:

Do you have a mailing list?

How long do you keep people on your mailing lists and can you
let me know if I am about to be removed?

What type of properties do you auction?

It may also be worth subscribing to certain pedigree property
magazines. These include Property Auction News, Under The Hammer
and Property Week. Local newsagents usually carry these.

THE INFORMATION AN AUCTIONEER WILL PROVIDE

Obviously they will provide the details of the properties going
under the hammer at their auctions. These tend to be more
detailed than the snippets given by estate agents (there are
laws such as the Property Misdescriptions Act 1991 which make it
illegal for auctioneers to give false information about a
property). On the whole, for any given lot they will provide:

Location

Construction details

Tenure (e.g. freehold)

Accommodation details (e.g. 3 bedrooms etc)

Notes (e.g. refurbishment required)

Viewing details

Solicitor details

Auctioneers usually publish a catalogue with the lot details -
this is a book detailing the various properties available at
auction. These will usually be available a month or less prior
to the auction date.

IDENTIFYING REPOSSESSIONS

Some banks/building societies can be sheepish about revealing
that they are selling repossessed properties so you need to be
alert in the auction for clues. Auction adverts may reveal that
a bank may be the seller of a number of properties, or the
auction catalogue may state a phrase such as ‘on instruction of
a liquidator’ or something similar - this should tell you that
the property being sold is a repossession. If you are unsure,
ask the auctioneer directly if the lot being offered is a
repossession.

at any given time all over the UK. It’s important to understand
how auctions work before purchasing a property from one. To find

Write brief phrases. Full sentences not necessary

Start with first draft. Expect to do several revisions

Begin with a summary statement that describes the functional areas of your work

Use present tense in describing current job. All previous positions are described in past tense

Support all activities and accomplishments with results and accomplishments

Describe specific responsibilities

Summarize early employment by briefly describing your functions at the end of the resume

Pick resume format and be consistent. Dates appear on the right side of the page

Write out all numerals up to and including the number “nine”. Use the numerical form from 10 -999,999

Lay out resume so that a job description or a sentence on the first page does not run over to the second

Proof read final product for correct spelling, punctuation, grammatical, and typological errors. Have independent, “critical” person proof read for errors you may have missed

Omit information or dates that may be used to screen you out

Resume Do Nots

Do not use italics, dashes, or underlining to emphasize items and make them stand out. They confuse scanners and electronic mail attachments

Do not use abbreviations. Use professional and technical information when it is relevant

Do not use odd-sized, bordered, or colored paper- any thing that may be considered eccentric

Do not include your picture with your resume

Do not list references, reserve them for interview or follow up activities

Do not include personal data, marital status, number of children, or “excellent health”

Do not devote more space to earlier jobs that more recent employment. Employers are interested in most recent, relevant experience

Do not list grade point average or college honors unless you are a recent grad

Do not leave gaps between employment dates. List jobs by year rather than by month and year. Briefly state a good reason for the gap, e.g. returned to school full time, worked on temporary jobs, or left career for family responsibilities
